PROCEDURE TO INSPECT EDUCATION RECORDS AND CORRECT EDUCATION RECORDS IF NEEDED

Parents have the right to inspect and review any education records relating to their child. The Texhoma Public Schools will respond to a request without unnecessary delay and in no case longer than 45 days after the request is made. If the record contains information on more than one child, parents shall have access only to the information about their child. Access rights include:

1. The right to a response to reasonable requests for explanation and interpretation of the records;

2. The right to request that the Texhoma Public Schools provide copies of the records containing the information if failure to provide those copies would effectively prevent the parents from exercising the right to inspect ad review the records.

3. The right to have a representative of the parents inspect and review the records.

4. The Texhoma Public Schools shall maintain, for public inspection, a current listing of the names and positions of those employees who may have access to confidential information. The following persons have access to the records: Special education teacher, regular teacher, administrator and designated administrative personnel, counselor, State Department of Education personnel, vocational- technical education personnel, parents/guardian, student (if appropriate and 18 years. old), related service providers, paraprofessionals, student teachers, school nurses and social workers.

Anyone not on the Texhoma Public Schools current listing must have parental permission to access confidential records. A form will be kept in each handicapped student's folder to record who accessed the records, on what date, and the purpose. The Texhoma Public Schools may presume that the parent has the authority to inspect and review records relating to his or her child unless we have been advised that the parent does not have the authority as a result of a court order in such matters as guardianship, separation, and divorce. Parents may request amendment of records. A parent who believes that the educational information/records collected, maintained, or used are inaccurate, misleading, or violate the privacy or other rights of the child may request the Texhoma Public Schools to amend the records. The Texhoma Public Schools shall decide whether to amend the information within a reasonable period of time after receipt of the request (45 days).

If the Texhoma Public Schools decides to refuse to amend the information, it shall inform the parent of the refusal and advise the parent of the right to a hearing. On request, the Texhoma Public Schools will provide an opportunity for a hearing to challenge information in educational records to ensure that it is not inaccurate, misleading, or otherwise in violation of the privacy or other rights of the child. A hearing challenging information in educational records shall be conducted according to procedures stated in the Family Educational Rights and Privacy Act (34 CFR 99.22).

If, as a result of the hearing, the Texhoma Public Schools decides that the information is inaccurate, misleading, otherwise in violation of the privacy or other rights of the child, it shall amend the information accordingly and so inform the parents in writing. If, as a result of the hearing, the Texhoma Public Schools decides that the information is not inaccurate, misleading, or otherwise in violation of the privacy or other rights of the child, it shall inform the parent of the right to place in the records it maintains on the child a statement commenting on the information or setting forth any reasons for disagreeing with the decision of the Texhoma Public Schools. Any explanation placed in the records of a child shall be maintained by the Texhoma Public Schools as part of the records as long as the record or contested portion is maintained by the Texhoma Public Schools. If the records of the child or the contested portion are disclosed by the Texhoma Public Schools to any party, the explanation must also be disclosed to that party.
